Terms and Conditions

Note: these Terms and Conditions are governed by French law. They are provided in English for the convenience of our international clients. In the event of any discrepancy, the French version shall prevail.

Article 1 – Purpose

These terms and conditions of sale (the "Terms") govern the contractual relationship between Ma Kabaan, a simplified joint-stock company (SAS) with share capital of €50, registered in Paris (75008), represented by Maé Clémensac, and any natural or legal person (hereinafter the "Client") wishing to purchase property inspection services offered by Ma Kabaan.

Placing an order for any service constitutes unreserved acceptance of these Terms.

Article 2 – Services

The following services are offered:

  • -Check-in inspections for residential lettings
  • -Check-out inspections for residential lettings
  • -Property inspections for commercial and professional premises
  • -Property viewings
  • -VEFA (off-plan) delivery inspections
  • -Condition surveys before and after works

Each service is the subject of a prior quote setting out the nature of the work, the applicable fee and any specific conditions.

Article 3 – Fees

Fees are those in force at the date of the order, as shown on the en.edl33.fr website or on the quote provided to the Client.

All prices are quoted in euros excluding VAT (excl. VAT).

Travel within a 15 km radius of Bordeaux is included in the fees. Beyond that, a surcharge of 0.80 €/km (return journey) applies, calculated only on the distance exceeding 15 km from Bordeaux city centre.

Ma Kabaan reserves the right to amend its fees at any time. The fees applicable are those in force at the time the order is confirmed.

Article 4 – Ordering and booking

Orders may be placed by telephone, email or via the forms on the en.edl33.fr website. Ma Kabaan confirms the order by email or telephone, indicating the date and time of the appointment.

Confirmation of the order constitutes the Client's acceptance of these Terms.

Article 5 – Payment terms

Payment is due upon receipt of the invoice, within 30 days of the invoice date, unless otherwise agreed.

Accepted payment methods: bank transfer and cheque.

In the event of late payment, late payment penalties will apply at an annual rate of three times the statutory interest rate, in accordance with article L.441-10 of the French Commercial Code. A flat-rate debt collection fee of €40 will also be due (article D.441-5 of the French Commercial Code).

Article 6 – Cancellation and rescheduling

The Client may cancel or reschedule their appointment free of charge up to 48 hours before the scheduled appointment.

In the event of late cancellation (less than 48 hours before the appointment) or failure by the Client or their representative to attend the appointment, a cancellation fee equal to 50% of the service fee will be due.

Ma Kabaan reserves the right to cancel or reschedule an appointment in cases of force majeure (severe weather, inability to access the property, etc.). The Client will be notified as soon as possible and a new appointment will be offered at no additional charge.

Article 7 – Service delivery

The inspection is carried out jointly, in the presence of the landlord (or their representative) and the tenant (or their representative). The report is signed electronically by those present.

The complete report, including photographs and meter readings, is sent to the Client electronically as soon as the inspection is complete.

If the inspection cannot be carried out (absence of a party, inaccessible property, etc.), Ma Kabaan is not liable for the delay and will propose a new appointment. Travel costs remain payable if Ma Kabaan has already travelled to the site.

Article 8 – Client obligations

The Client undertakes to:

  • -Provide the information necessary for the proper performance of the service (exact address, access details, contact details of the parties)
  • -Ensure access to the property on the day of the appointment
  • -Notify Ma Kabaan of any particular difficulty relating to the property or the parties
  • -Pay for the service within the agreed timeframe

Article 9 – Liability

Ma Kabaan undertakes to carry out its services with the care and diligence required, in accordance with professional standards and applicable regulations.

Ma Kabaan's liability is covered by professional indemnity insurance. In any event, Ma Kabaan's liability is limited to the amount of the service fee invoiced.

Ma Kabaan cannot be held liable for the consequences of any disagreement between the parties (landlord and tenant) as to the interpretation of the inspection report.

Article 10 – Intellectual property

Inspection reports, photographs and any document produced by Ma Kabaan in the course of its services remain the property of Ma Kabaan. The Client is granted a non-exclusive right of use for the purposes of managing their property.

Article 11 – Data protection

The processing of personal data is governed by our privacy policy.

Article 12 – Complaints

Any complaint must be sent to Ma Kabaan by email at mae@edl33.fr or by recorded delivery letter with acknowledgement of receipt within 30 days of the service being carried out.

Ma Kabaan undertakes to examine each complaint diligently and to respond within a reasonable timeframe.

Article 13 – Mediation

In the event of a dispute that cannot be resolved amicably, a consumer Client may use the free consumer mediation service. The competent mediator will be provided upon request.

Article 14 – Applicable law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and after failure of all attempts at amicable resolution, the courts of Paris shall have sole jurisdiction.

Article 15 – Updates

These Terms may be amended at any time. The Terms applicable are those in force at the time of the order.
